Hungarian plant variety

The number of new varieties of plants has increased in the past few years. Taking this into consideration, our office has established the Hungarian BIOPATENT^® Center, where we focus our attention on counseling biotechnological developers, plant breeders as well as taking care of these inventions. We help our foreigner partners in acquiring protection in Hungary and in the European Union.

We need the followings applying for protection in Hungary:

• denomination,
• description of the species,
• morphological and fenological description,
• application sheet of DUS examination, completed by an accredited institution with the technical questionnaire,
• 4 photographs,
• statement on the novelty of the dissemination material,
• signed power of attorney.

The protection endures for 25 years generally and for 30 years in case of grapes and trees after granting. The first day of the protection is the day of filing.

The report of DUS examination needs to be filed within 4 years after the date of priority. Extension of this term is possible. The application can be modified adjusting to the results.

For filing an application for Community Plant Variety Right we need the followings:

• denomination,
• description of the species,
• filled technical questionnaire,
• 4 photographs,
• signed power of attorney.

Usually an authority designated by the Community Plant Variety Office carries out DUS examination. The Office sends a notification of the designation to the applicant. This letter contains a notice of the type, quality and quantity of plant material needs to be submitted. The designated authority prepares interim reports after each growing period and a final report at the end. Comments can be made by the applicant within 2 months after receiving a report. The Office may take over examination conducted by an authority not designated, if the plant variety is already benefiting from national plant variety rights or entered for national listing in a member state of the European Union.

Color photographs are required in case of fruits and ornamental species. Applicants need to provide a photograph of the plant as a whole and a close-up photograph of the flower or fruit or any other relevant part of the plant.

The time period of the protection also 25 years, and 30 years for vines, trees, and potatoes.
